General provisions DigiDala is a digital service operating within the Telegram ecosystem and including a Telegram bot and Mini App. The service allows users to participate in creating and completing digital mandalas, post messages and visual content, use free features and, where provided, purchase digital values within the service. DigiDala is operated by **Individual Entrepreneur Ivan Ilyich Mironov**. DigiDala is not part of Telegram and is not operated by Telegram. The user must also comply with the applicable Telegram terms and rules. ## 2. Acceptance of the Agreement By using DigiDala, the user confirms that they have read this Agreement and the DigiDala Rules and accept them to the extent permitted by applicable law. Before the first paid operation, the following must be available to the user: - this User Agreement; - DigiDala Rules; - Privacy Policy; - payment and refund terms. Where a separate confirmation is required for a particular operation, the user must confirm that they have read the applicable terms before completing payment. ## 3. Age and legal capacity The user is independently responsible for complying with legal requirements, including requirements relating to age and the ability to enter into agreements. If use of DigiDala is prohibited for the user under applicable law, the user must not use the service. ## 4. Service status and development DigiDala is under development and may change. The service may experience errors, temporary unavailability, synchronization delays, changes to the interface, mechanics, content and individual functions. The Operator may change, temporarily restrict or discontinue individual DigiDala functions subject to mandatory requirements of applicable law. The mere existence of technical changes or temporary unavailability does not by itself constitute a breach of obligations if the relevant circumstance does not create an obligation of the Operator toward the user under applicable law or the terms of a specific operation. ## 5. User content The user retains rights to content belonging to them to the extent provided by applicable law. By posting a message, image or other material in DigiDala, the user grants the Operator the rights necessary to store, technically process, reproduce and display that material within DigiDala, and to use it to provide the user-facing function, perform moderation, maintain security and resolve complaints. The user warrants that they have the necessary rights to post the content and that its publication does not violate the law, third-party rights or these Rules. ## 6. Mandalas, cells and participation The specific mandala mechanics, participation cost, number of Pix and other conditions of an operation are determined by the DigiDala interface and the description of the relevant function before the operation is performed. An occupied cell, participation record and operation history may remain in the system after completion or moderation of the relevant cycle. Hiding public content does not by itself mean that the technical participation history is deleted. ## 7. Pix **Pix** is an internal digital unit of DigiDala used for actions provided by the service mechanics, including participation in paid cells. Pix are not money, a bank account, cryptocurrency or an independent payment instrument. Unless the DigiDala interface expressly states otherwise, Pix are intended only for use within the service and cannot be withdrawn by the user as money or Telegram Stars. The user purchases the internal digital value specified in the invoice for DigiDala, not Telegram Stars. ## 8. Telegram Stars and paid operations For the sale of digital goods and services inside Telegram, DigiDala uses Telegram Stars in accordance with Telegram rules. DigiDala may provide different types of operations, including: 1. **"Support the project"** — a voluntary payment to support the project, without automatic provision of a separate digital value in return unless the operation interface expressly states otherwise. 2. **Purchase of a digital value**, such as Pix — an operation in which, after successful payment, the user receives the digital value of DigiDala specified in the invoice. The price and content of a paid operation are shown to the user before payment. ## 9. Moderation and access restrictions The Operator may apply moderation measures provided by the DigiDala Rules, including hiding the user's name, message, cell content or public mandala visual, temporarily restricting access or blocking access. Moderation is intended to manage public visibility and service safety and does not by itself mean automatic deletion of participation history, cancellation of a completed operation or refund of a payment. Payment questions and refunds are handled separately under Section 10 of this Agreement, the payment and refund terms and applicable law. ## 10. Refunds and payment inquiries Refund rules are determined by applicable law, this Agreement, the terms of the specific operation and Telegram rules. The Operator does not guarantee a refund solely because the user changed their mind, did not read the description, expected different functionality or did not use the digital value received, **unless mandatory applicable law provides otherwise**. Erroneous charges, failure to provide a paid digital value, an incorrect amount, a material technical error and other payment problems are handled through payment support. The Operator accepts purchase-related inquiries through the Telegram `/paysupport` command and at `digidala-sup@yandex.ru`. An automated refund process may be performed separately after the inquiry has been reviewed. ## 11. Limitation of liability To the extent permitted by applicable law, the Operator is not liable for indirect losses and consequences arising solely from: - temporary unavailability or technical limitations of Telegram; - failures of the user's device, network or software; - failures or changes in third-party services on which Telegram or DigiDala depends; - actions by the user that violate this Agreement or the Rules. Nothing in this Agreement excludes or limits rights or liability that cannot legally be excluded or limited. ## 12. Third-party services and Telegram Use of Telegram is governed by Telegram's terms. DigiDala is not owned by Telegram and does not control its operation, availability, Telegram Stars pricing or the rules of relevant app stores and payment providers. Telegram rules apply to the use of Stars and the payment infrastructure for digital goods and services inside Telegram. ## 13. Changes to the Agreement The Operator may update this Agreement and related documents. The current version is published through channels available to DigiDala users. For operations already completed, the terms applicable to the relevant operation remain applicable to the extent that mandatory law does not require otherwise. ## 14. Applicable law and dispute resolution This Agreement is governed by the laws of the Russian Federation unless mandatory legal provisions applicable to a particular user or situation provide otherwise. The user may send an inquiry or claim to the Operator at `digidala-sup@yandex.ru`. The Operator will review such inquiries within a reasonable period. Disputes that cannot be resolved in this way are subject to resolution by a competent court in accordance with applicable law.
